How Does The Process of Sealing Juvenile Records Work?

When you contact our office we will offer you a free consultation to see if you are eligible to have your juvenile records sealed. If you are eligible we will file the petition to seal your juvenile record.

After our consultation, we draft the petition. Once it is drafted we will serve a copy on the probation department and district attorney. They will prepare and file their opposition to our petition. A court hearing will be scheduled where we can argue your case.

When the petition is granted, the court will sign an order mandating the Department of Justice to destroy your California juvenile court record. Under California law, the minute the juvenile records are sealed, “The arrest and conviction are deemed void and considered never to have occurred”. If you are ever asked respond to the question, “have you ever been arrested or convicted of a crime?” You can lawfully answer “NO”.

There are Tremendous Benefits in Sealing your Juvenile Record

Once your records are sealed, no one will be allowed to discover your California juvenile court records. If a background check is performed on you, the police agency, the court or law enforcement agency must answer that they have no record of your matters.

Most importantly you can legally answer “no” when asked on an employment application job or licensing application whether you’ve ever been arrested or convicted of crime. Your sealed record means the juvenile arrest and conviction never occurred.

Are you Eligible to Seal your Juvenile Records?

To qualify, you can not have of another felony or a misdemeanor involving moral turpitude since your conviction. In addition your conviction can not be for any of the crimes listed in Welfare and Institution Code section 707(b). These crimes cannot be sealed if the minor was 14 years of age or older when the crime occurred. Crimes found under Welfare and institutions code 707(b) crimes are considered the most serious offenses; they include crimes of murder, robbery, rape, kidnapping and child molestation.
